Subject: [Patents] PATNEWS: WWW.BUSTPATENTS.COM - PATNEWS' new Web site
!20000124 WWW.BUSTPATENTS.COM - PATNEWS' new Web site
For five years, the folks at the University of North Carolina have
kindly provided space on their servers to host my patent Web site. Many
enjoyed viewing it, and hopefully it played a small role in getting the
PTO to place the full text of patents on the Internet.
But I have always wanted a more commercial site, and a more activist
site. Thus for six months, I have been slowly building a new Web site, to
to the point where I can expose it to the world. The site focuses on the
economics and legal analysis of patents for software/Internet/ecommerce
and biotechnology/bioinformatics. The URL is, quite naturally:
www.bustpatents.com
The Web site has two sections - an extensive public area, and a smaller
more indepth private section. Other than my large regular clients, access
to the private section is available for a fee (see below). Here is a quick
guide to the Web site, sections of which will be covered in more detail
the rest of the week. First are Web pages from the public section:
www.bustpatents.com/exam.htm
Commentary and past PATNEWS on problems the Patent System has
in general that leads to the low quality of many patents
being issued.
www.bustpatents.com/software.htm
Critiques of software patent examination, governmental guidelines
on software patents, and legal reviews/articles on software
patents most available at law firms' and law schools' Web sites.
www.bustpatents.com/invalid.htm
A list of software patents that have been invalidated either
by the PTO (reexam) or the courts (lawsuits). I have tracked
down 53 so far, and would appreciate being informed about others.
A smaller list (but to be greatly expanded in the future) of
patents which should be invalidated (with some prior art examples)
is also provided.
www.bustpatents.com/biotech.htm
Reviews of bioethics of patent technologies, governmental guidelines
on biotech patents, and legal reviews/articles on biotech
patents most available at law firms' and law schools' Web sites.
www.bustpatents.com/economics.htm
Collections of data on the economics of patenting (especially
law firm Web sites that publish a list of the costs of their
services), as well as an extensive list of links to papers on
the Web dealing with the economics of patent litigation,
licensing and national policy.
www.bustpatents.com/sites.htm
A length list of sites on the Web offering rich sources of
information on the patent system - 21 government agencies,
20 private organizations, and a variety of online law school
journals.
www.bustpatents.com/archive.htm
A list of the titles to the 1000+ PATNEWS sent out over the last
seven years, most of which in the past few years have only been
sent out over PATNEWS.
www.bustpatents.com/photos.htm
Photographs of parts of the Patent Office (an examiner's office,
some shoeboxes), and in time, photographs of the many libraries
around the country I use to bust patents (including the eggheads
at UCDavis :-).
You should find these Web pages quite informative, and I would appreciate
suggestions for additional links to add to the pages. Lawyers and
academics with papers that they want to have posted at the site, please
contact me.
====
The private section (samples of which are available in the public section)
have even more valuable information on their Web pages. To support the
further development of these Web pages, and to expand PATNEWS, I will be
charging for access to these Web pages (except for my largest clients).
These Web pages offer (and the fee includes a CDROM snapshot of the
entire Web site):
- HTML full text versions of PATNEWS
10 megabytes of stories going back to the first PATNEWS sent out
in August 1993.
- Infringement awards and license fees
A table of data on patent infringement awards, settlements, and
license fees greater than $1,000,000. Over time I will be making
available tools to help determine the value of patent portfolios,
including a licensing spreadsheet. A list of all of the prior
awards publicly disclosed, with a few samples, is available at
www.bustpatents.com/awards.htm
- Filewrappers, reexams, lawsuits, decisions
I am gradually building up a collection of HTMLed versions of
software/biotech patent filewrappers, reexam requests, infringement
lawsuit filings, and court decisions. A list of all of the
available documents, with a few samples, is available at
www.bustpatents.com/filings.htm
- 10-K and 10-Q patent commentaries
I am gradually going through 10-K and 10-Q reports, extracting
the commentary that deals with patenting and intellectual property.
This page will be a basis for offering stock market investment
advice based on companies' IP activities. A list of all of the
available summaries, with a few samples, is available at
www.bustpatents.com/sec.htm
- CAFC appeals court decisions on software patents and copyrights
Mostly of historical interest, HTML versions of CAFC and Supreme
Court decisions going back 20 years that trace key developments
in software patent and copyright rulings. A list of all of the
available rulings, with a few samples, is available at
www.bustpatents.com/cafc.htm
- IP rights around the world
Excerpts of analyses of intellectual property rights laws and
practices for over 100 countries around the world. A list of
all of the available analyses, with a few samples, is avaiable at
www.bustpatents.com/foreign.htm
- Automated patents claims analysis
For some time, I have been developing a tool to analyze patent
claims, the beginning of an effort to develop a tool to determine
how invalid a portfolio of patents is (call it the anti-Aurigin).
The private area has a Web page where you can enter the text of
a set of claims, and have returned an analysis of the claims.
The public area has a sample output for some modified claims from
one of the worst written set of patent claims. For more,
www.bustpatents.com/claims.htm
====================
As you can see, a lot of goodies. Unfortunately those goodies in the
private, Members Only, area will require a fee to get access to. Much
of the monies I receive will be used to hire assistants to type in mounds
of paper I have been collecting, as well as acquire more. The fees:
Individuals - $100
Lawyers/Executives - $200
Law firms/Corporations - $2,000
Large Corporations / Government Agencies - $20,000
Access to the Members Only area requires a password, which will be
supplied by email or phone when we process your order form. The fee is
currently a one time fee, but a few years hence may become a reduced
annual fee, or be eliminated altogether as STO raises investment funding
to buildup the Web site. And for most of those who have received
PATNEWS for many years (especially those in the developed countries),
the fee will become mandatory.
Members also are provided with a CDROM that is a snapshot of the Web
site at the time of ordering, including an archive of the fulltext to
all PATNEWS stories since 1994, over 1000 email news items, comprising
over 10 megabytes of HTML text. To order, please use the following form.
