got it working
iwconfig ath0 mode 3
and the access point suddenly started talking to it.
Anyone have any ideas how to get it to scan modes automatically.

ps. thanks to all those who suggested setting the ap, but its currenly set
to
any, iwconfig is just displaying that as a blank for some reason.
