Technically, yes. Politically, no. Filter your mailing list mail
through the same anti-spam setup you use on the rest of your mail, and
the problem goes away. As a bonus, it solves the problem for all the
other mailing lists you are on also, and is less time and effort than
having this argument (which incidentally has been coming up for 5+
years on ILUG).
