turns out the recovery was simple.

the fact that testdisk was able to see the file structure despite the 
lack of superblocks meant that I could copy the files to a new 
hard-drive from within testdisk, rebuild the partition, and copy them 
back (the initial problem was a mistake on my part while creating the 
partition - not a failed disk).

for the others that replied, thanks. Vicente, couldn't use that link as 
it assumes there are superblock backups. Conor, nope - not LVM. Paul, 
Photorec ignores the filesystem and I think it only extracts files that 
it recognises (images, video, etc).
