I am subscribed to an email list, and the message which i have
included below arrived to me via that list.
It appears the information that Dermot Beirne is out of his office is
now in my possession. As your disclaimer states:
"The information in this email is confidential"
Which means i now have confidential Exel information that Dermot is
out of his office for his while. Further it is stated this
"may be legally privileged"
which is worrying. What does this mean? Am i in danger of facing
legal action now for accidently learning that Dermot is out of the
The email goes on to state:
"It is intended solely for the addressee. Access to this email
by anyone else is unauthorized"
Which confuses me, and hence adds to my worries. What does
Does it mean the SMTP envelope recipient? If so, that would be
"ilug at linux.ie" - which isnt me! ilug at linux.ie is a mailling list and
expands to the many many people (most of whom dermot does not know).
So does this mean the ilug list software contravened your disclaimer
by resending Dermot's message? Of course, when the mail arrived at my
machine, the envelope recipient was me, paul at clubi.ie - but then
again neither dermot nor exel.com explicitely sent this email to me.
A similar argument applies to the message header "To:" addressee
(which need not correspond to the envelope recipient).
There is the final possibility that it means "whoever the sender
meant to send it to". but this would be silly as it would require
recipients to have the power of long-distance telepathy in order to
ascertain whether and how they should act on your disclaimer, and i
do not for a moment believe that a company as esteemed as yourselves
would have a disclaimer so stupid as to require 'telepathy' on the
part of the recipients. Hence I can not assume that Dermot intended
me to receive the email and hence i can not put my mind at ease.
Then you state:
" If you are not the intended recipient, any
disclosure, copying, distribution or any action taken
or omitted to be taken in reliance on it, is prohibited and
may be unlawful"
as well as:
" If you are not the intended addressee please contact the
sender and dispose of this e-mail."
So i should contact Dermot.
However, by his message i know that he is out of the office for a
while, so there isnt much point emailling him in order to clarify
this matter in a speedy manner, so perhaps i'd better just email
generic 'systems manager' and 'support' addressess at exel.com
instead. However, then i'd be acting on the knowledge that may have
unintentionally have been sent to me, which would contravene your
disclaimer. What am i to do?
Anyway, I'm in a real bind. This email and its disclaimer have me
really flustered and worried - I dont know what to do, i live in fear
of legal action! Because of this I cant sleep at night, I'm cranky
and people around me are suffering because of this, I'm distracted
and probably now at a higher risk of not noticing lamp posts, holes
in the road and hence potentially injuring myself (which is a further
worry), and finally my blood pressure has probably gone up and i
should probably go see a doctor to check on this.
Anxiously awaiting your advice.
